Regardless of how long this process is becoming for you, there are certain things you should never do in an interview session with a potential candidate. Here are three things that should never be done during the interview process:

You should never ask the candidate their age – The Age Discrimination in Employment Act (ADEA) forbids age discrimination against people who are age 40 or older. It does not protect workers under the age of 40, although some states have laws that protect younger workers from age discrimination. Unless there is a possibility that the candidate is under the legal age to work in the position, this question should be off the table entirely.

You should never ask anything about religious affiliation – Regardless of what your nonprofit organization is based around and whether it has a religious background or not, you should never ask a potential candidate about their religious affiliation. This is illegal under federal law, as all possible candidates’ race, religion, sex, nationality, and age should not be addressed during an interview.

You should never initiate questions about family life – It does not matter whether someone is male or female, it is illegal to ask a potential candidate about their current family life or what their plans are for a family in the future. This includes asking about if they have children or if they plan on starting a family.
